DIVELUX Post — Terms of Service

These Terms are an agreement between you and DIVELUX INC, Irvine, California, USA ("DIVELUX", "we", "us") for your use of DIVELUX Post at post.diveluxsaunahat.com (the "Service"). By signing in or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. What the Service does

DIVELUX Post lets you sign in with your TikTok account, upload a video file you own, write a caption, choose your post settings (who can view the video, whether others can comment, duet or stitch, and whether the video is promotional) and post it to your own TikTok account through TikTok's official Content Posting API, or send the video to your own TikTok inbox so you can finish editing and post it in the TikTok app. A video is posted only when you press Post, or when you post the inbox draft yourself in TikTok.

The Service does not create, edit, schedule or find content for you, and it does not post to any account other than the one you signed in with.

2. Who can use it

You must have a TikTok account in good standing, meet TikTok's minimum age requirements and be at least 13 years old. If you are under the age of majority where you live, you may use the Service only with permission from a parent or guardian. If you use the Service for a business, you confirm you are allowed to act for that business.

3. TikTok's rules also apply

Posts are published by TikTok and must follow TikTok's Terms of Service, Community Guidelines, Music Usage Confirmation and, for promotional content, the Branded Content Policy. TikTok decides whether a post is accepted, how it is labeled and who can see it. TikTok may limit how often an account can post; when that happens the Service will ask you to try again later. DIVELUX is not affiliated with, endorsed or sponsored by TikTok.

4. Your content

You keep all rights to the videos and captions you upload. You give DIVELUX a limited, non-exclusive, royalty-free permission to store your file temporarily and transmit it with your caption and settings to TikTok, only to perform the post you requested. This permission ends when the file is deleted (see the Privacy Policy).

You are responsible for your content. You confirm that you own it or have all rights and permissions needed to post it (including music, people shown and trademarks), that it is accurate about any paid promotion, and that it does not break the law or TikTok's rules.

5. Acceptable use

You agree not to:

• upload content you do not have the right to post, or content copied from other people or platforms without permission;
• use the Service for spam, misleading content or content that violates TikTok's Community Guidelines;
• automate the Service, post on behalf of accounts you do not control, or try to get around TikTok's posting limits;
• interfere with the Service, probe it for vulnerabilities without our permission, or upload malware;
• use the Service in violation of any law.

We may block uploads or suspend access if we reasonably believe these Terms are being broken.

6. Price

The Service is currently free of charge. If we ever introduce paid features, we will announce them in advance and you will not be charged unless you explicitly choose a paid option.

7. Disconnecting and ending use

You can stop using the Service at any time. Account → Disconnect and delete my data revokes our access to your TikTok account and deletes your data, as described in the Privacy Policy. We may stop offering the Service, or end your access, with reasonable notice where possible; if we do, we will delete your data as described in the Privacy Policy.

8. Availability

We work to keep the Service running, but it may be unavailable at times, for example during maintenance, because of TikTok API changes or limits, or for reasons outside our control. Processing on TikTok's side can take a few minutes.

9. Disclaimer

The Service is provided "as is" and "as available". To the extent permitted by law, DIVELUX makes no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, and does not guarantee that a post will be accepted or shown by TikTok.

10. Limitation of liability

To the extent permitted by law, DIVELUX is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data, followers or reputation, arising from your use of the Service. Our total liability for any claim related to the Service is limited to one hundred US dollars (US$100). Some jurisdictions do not allow these limitations, so they may not apply to you.

11. Indemnity

You agree to compensate DIVELUX for reasonable losses and legal costs resulting from content you post through the Service or from your breach of these Terms, to the extent permitted by law.

12. Governing law

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules. Disputes will be heard in the state or federal courts located in Orange County, California, unless the law where you live gives you the right to bring a claim in your local courts.

13. Changes to these Terms

We may update these Terms. We will change the date at the top of this page, and for material changes we will show a notice in the Service before they take effect. Continuing to use the Service after that means you accept the updated Terms.
